Distance & Sales Contract

DISTANCE SALES CONTRACT

1. Parties

This agreement is signed between the following parties in accordance with the terms and conditions set out below.

“Buyer” (hereinafter referred to as the “Buyer” in the contract)

By accepting this agreement, the Buyer agrees in advance that if the Buyer approves the order subject to the contract, they will be obliged to pay the price subject to the order and any additional fees such as shipping fees and taxes, if any, and is informed of this.

2. Definitions

In the application and interpretation of this agreement, the following terms shall have the meanings set out below:

  • Minister: Minister of Customs and Trade
  • Ministry: Ministry of Customs and Trade
  • Law: Law No. 6502 on Consumer Protection
  • Regulation: Distance Contracts Regulation (Official Gazette: 27.11.2014 / 29188)
  • Service: Any consumer transaction other than the provision of goods performed or committed to be performed in exchange for a fee or interest
  • Seller: The company that offers goods to the consumer within the scope of its commercial or professional activities or acts on behalf of or on account of the supplier of goods
  • Buyer: A natural or legal person who acquires or uses a good or service for non-professional purposes
  • Site: The Seller’s website (https://wallaplus.com)
  • Orderer: The natural or legal person who requests goods or services through the Seller’s website
  • Parties: The Seller and the Buyer
  • Contract: This Distance Sales Contract concluded between the Seller and the Buyer
  • Goods: Movable goods subject to exchange and software, audio, images and similar intangible goods prepared for use in electronic environment

3. Subject

This agreement regulates the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on Consumer Protection and the Distance Contracts Regulation in relation to the sale and delivery of the product specified below, which the Buyer orders electronically via the Seller’s website.

The prices listed and advertised on the Site are the sale prices. Announced prices and commitments are valid until updated or changed. Prices announced for a specific term are valid until the end of that period.

Contract Subject Product(s) Information

The main characteristics of the goods/products/services (type, quantity, brand/model, color, quantity) are published on the Seller’s website. If a campaign is organized by the Seller, you can review the main characteristics of the relevant product during the campaign period. Campaigns are valid until their specified end date.

The shipping fee, which is the cost of shipping the product, will be paid by the Buyer.

Invoice delivery: The invoice will be delivered together with the order to the invoice address during order delivery.

General Provisions

All general provisions (Articles 9.1 – 9.16) of the Distance Sales Contract as provided in the original template apply equally to WallaPlus. This includes Buyer acknowledgment, delivery timelines, Seller’s obligations, right of withdrawal, communication consent, and liability terms.

Right of Withdrawal

The Buyer may exercise the right of withdrawal within 14 (fourteen) days from the date of delivery to the Buyer or the person/organization indicated by the Buyer, without any justification and without any penalty, by notifying the Seller in writing (email to info@wallaplus.com is accepted). All conditions and exceptions described in Articles 10.1 – 10.2 of the standard Distance Sales Contract shall apply.

Products That Cannot Be Returned

Products that are produced or personalized upon the Buyer’s request, products that are clearly personal in nature, or those that are unsuitable for return due to health and hygiene reasons after the package is opened cannot be returned. Custom wallpapers and printed materials produced specifically for the Buyer are non-refundable once production begins.

Default and Legal Consequences

If the Buyer defaults on payment, they shall be responsible for paying interest and any resulting costs according to the credit card agreement between the Buyer and the bank. The Buyer agrees to indemnify WallaPlus for any damages arising from delayed payment.

Competent Court

Complaints and objections regarding this agreement shall be submitted to the Consumer Arbitration Committee or Consumer Court at the Buyer’s place of residence or where the consumer transaction took place, within the monetary limits determined by law.

Force

The Buyer is deemed to have accepted all terms of this agreement once payment for the order is completed on the Site. The Seller (WallaPlus) is responsible for ensuring that the Buyer confirms this agreement electronically before the order is finalized.
